There is no confirmed civil lawsuit or settlement in the Rudy Ornelas case. Ornelas, a Sacramento barbershop owner, posted video of a late-2018 traffic stop in which a Sacramento police officer pointed a gun at him, and he said he won his criminal case in August 2019. Online claims that he sued the city and collected a payout have no source in the news coverage or court records we could check.
This guide separates what is confirmed from what is only claimed, and tells you where to verify the rest.

Who is Rudy Ornelas?
CBS Sacramento identified Rudy Ornelas as a barbershop owner when it reported on his video in September 2019. Ornelas posted the footage online in 2019 and has said he did so after winning his case that August. Little else about him is in the news record, and we don’t repeat claims about his life that no outlet has reported.

What happened during the traffic stop
The details below come from CBS Sacramento’s September 9, 2019 reports and the video as they described it. Where the facts are Ornelas’s own account, we say so.
- The stop. Police in north Sacramento pulled him over for tinted windows. One CBS report places the stop in November 2018, while another says “last October,” so treat the exact month as uncertain.
- The ticket. He says he had a “fix-it” ticket for the window tint and front plate. In the other report, the driver said officers changed their reason for the stop after he showed it.
- The gun in the trunk. He told officers his license was in a backpack in the trunk, along with a firearm registered in his name.
- The standoff. He refused to get out of the car until a supervisor arrived and asked why he had been stopped.
- The gun. In the video, one officer says she doesn’t feel comfortable standing alone during the search. A female officer then steps back and points her gun at him as he argues with her partner.
Ornelas says the search was illegal and that the gun was pointed at his head. Those are his statements, not court findings.
The other side
Sacramento police confirmed the stop took place and declined to comment further. Citing department policy, a CBS report noted that officers may draw a firearm during an arrest or investigation, or when they reasonably believe it is necessary for safety.
Former Sacramento County Sheriff John McGinnis told CBS the stop was handled by the book. He said officers had authority to point the gun, that Ornelas was refusing a lawful request, and that he saw no legal problem. That is one former law-enforcement leader’s opinion, not a ruling, and it does not settle whether the stop was proper.
Did Rudy Ornelas file a lawsuit?
We found no confirmed civil lawsuit against the Sacramento Police Department or the City of Sacramento. The two CBS Sacramento reports from September 2019 do not mention one. A search of news coverage and the public court sources we could reach turned up no civil rights case in his name. A federal court-records search we tried was blocked, so we could not rule out a filing there.
Why people search for a “lawsuit” anyway:
- Ornelas said he won his case. That refers to the criminal charges against him, not a lawsuit he filed.
- Social media posts about the video, including a reply from an AI chatbot on X, claim he sued the police department. They name no court, case number or judgment.
- Several websites titled “Rudy Ornelas lawsuit” discuss a civil case or a large award without citing any record. At least one of them says outright that no civil judgment record is publicly available.
Did Rudy Ornelas win?
In his account, yes, in the criminal case. Ornelas said he won in August 2019. According to the video as described by CBS, he had been cited on numerous charges that were dropped. One gun charge was still pending in September 2019, and he said his lawyer told him it would be dismissed and his gun returned if he stayed out of trouble for two months and finished an eight-hour firearm safety class.
What we could not confirm:
- The charges. The Sacramento County District Attorney’s Office could not tell CBS what he was charged with or which charges were dropped.
- The final outcome of the gun charge. We found no record that it was resolved.
- Why the charges were dropped. Some websites say a court found the search illegal. We found no court document saying so.
Is there a settlement?
No settlement is confirmed. Figures that circulate online, including a specific dollar amount tied to a civil suit, appear without any court record, case number or news report behind them. A settlement would normally leave a trail in court filings or in a city council or risk-management record. We found none.
What happened to the officer?
Sacramento police called it a personnel matter and declined to comment, and the officers were not named in the CBS reports we reviewed. We found no public record of discipline, promotion or removal. Websites that state what happened to the officer cite no source for it.
Rudy Ornelas lawsuit update
As of October 19, 2026, we found no new court filing, ruling or settlement connected to Ornelas and the stop. The video continues to circulate on social media, and the posts that accompany it repeat the unsupported claims above. If a record is filed, it would appear in Sacramento County Superior Court or federal court, not in a viral post.
Don’t confuse this with other “Ornelas” cases
The surname is common, and a search for “Ornelas lawsuit” brings up unrelated matters involving other people, including a New Hampshire jail case. None of the unrelated matters we found concerns the Sacramento stop.
Court-records sites also list a Sacramento County Superior Court case, number 34-2019-00251560-CU-BC-GDS, titled “Rudy Ornelas vs. General Motors LLC.” One listing describes it as a breach-of-contract or warranty suit filed in February 2019 that was dismissed that June. We could not open the record, and nothing shows it involves the same person. It has no connection to the police stop that we could find.
Reading from the UK or Canada?
This is a US case under California law, in a Sacramento court. Police gun-drawing rules, the court process and the way claims are filed differ in the UK and Canada, so the points above don’t transfer.
If you think a police stop violated your rights
Deadlines for civil claims are short and vary by state, and some claims against a city require a notice first. Write down what you remember now, keep any video, and speak with a licensed civil rights attorney in your state before deciding. How we researched this
I read the two CBS Sacramento reports from September 9, 2019, the Sacramento Police Department statements they quote, and the sites that describe the case, and I searched for court filings and docket listings under the name on or before October 19, 2026. I checked every claim on those sites against the CBS reports. Many are repeated without sources, and we leave them out. I could not open the federal court-records database, and I did not reach the Sacramento County court system directly. Statements by Ornelas are labeled as his, and opinions are labeled as opinions.
